Dubai's residential market remains one of the most active in the world for foreign investment, thanks to freehold ownership, no property or capital gains tax, and a transparent Dubai Land Department (DLD) registration system. But "buying a flat in Dubai" covers two very different processes — ready (secondary) property and off-plan property — and the risk profile of each is not the same.
Ready property: the process
- Agree terms with the seller and sign the MOU (Form F) via a RERA-registered broker
- Pay the deposit (typically 10%) into an escrow or the broker's trust account
- Obtain a No Objection Certificate (NOC) from the developer confirming no outstanding service charges
- Transfer at DLD — both parties attend, remaining balance is paid, and the title deed is issued in the buyer's name same day
Timeline: 2–8 weeks depending on financing. Key risk areas: overpaying relative to actual market value, undisclosed service charge arrears or disputes, and structural or MEP issues in older buildings not visible on a standard viewing.
Off-plan property: the process
- Reserve the unit with the developer, sign the Sale and Purchase Agreement (SPA)
- Payments follow a construction-linked or post-handover plan (e.g., 60/40, 70/30) — funds are held in an escrow account regulated by RERA
- Oqood registration — an interim registration with DLD during construction
- Handover and title deed issuance once the developer obtains a completion certificate
Key risk areas: developer delivery risk (always check the developer's track record and escrow account status via the DLD's Rera portal before committing), payment plan mismatch with your actual liquidity, market risk between reservation and handover, and quality or specification gaps between marketing materials and delivered product.
Ready vs off-plan: which fits your strategy?
Where investors get caught out
- Relying solely on the agent's comparable pricing — an independent valuation gives you a defensible, unbiased figure to negotiate from
- Not verifying escrow compliance on off-plan projects before paying a deposit
- Ignoring service charge trends — a building with rising or poorly managed service charges erodes net yield regardless of purchase price
- Skipping a condition survey on secondary/ready units, particularly units over 10 years old
The role of an independent valuation
Whether ready or off-plan, an independent RICS-regulated valuation gives you:
- A defensible market value to negotiate against the asking price
- A basis for mortgage financing (UAE banks require an independent valuation before releasing funds)
- Protection against overpaying in a market where listing prices and achieved prices frequently diverge
Why work with an investment advisor, not just a broker
